PRIVACY POLICY | ||||||||||
1. | This Privacy Policy determines principles of processing personal data obtained through online shop www.sklep.geocover.pl (hereinafter referred to “Online Shop”). | |||||||||
2. | The owner of Online Shop and simultaneously administrator of data is Geocover LLC with legal seat in Lodz (94-104), 102/104 Obywatelska Street, entered into register of entrepreneurs of National Court Register conducted by Her Majesty’s Government XX Economic Department of National Court Register under number KRS 0000431916, hereinafter referred to as Geocover. | |||||||||
3. | Personal data collected by Geocover through Online Shop are processed according to Regulation of the European Parliament and the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR. | |||||||||
4. | Geocover uses its best efforts to respect privacy of Customer visiting Online Shop. | |||||||||
§ 1 Kind of processed data, objectives and legal basis | ||||||||||
1. | Geocover collects information concerning natural persons undertaking legal act not related directly to their activity, natural persons running on their behalf business or professional activity and natural persons representing legal persons or organizational entities that are not legal person, to which act of law grants legal capacity, hereinafter referred to as Customers. | |||||||||
2. | Personal data of Customers are collected in the case of: | |||||||||
a) | registration of account in Online Shop in order to establish individual account and manage this account. Legal basis: necessity for execution of contract of provision of service of Account (article 6 section 1 letter b GDPR), | |||||||||
b) | placing order in Online Shop in order to execute sale contract. Legal basis: necessity for execution of sale contract (article 6 section 1 letter b GDPR), | |||||||||
c) | using services of contact form in Online Shop in order to execute contract provided electronically. Legal basis: necessity for execution contract of service of contact form (article 6 section 1 letter b GDPR). | |||||||||
3. | In the case of registration of account in Online Shop, Customer gives: | |||||||||

c) | first name and surname | |||||||||
d) | phone number | |||||||||
4. | During registration of account in Online Shop Customer fixes on his own individual password of access to his account. Customer can change password later on the principles described in § 5. | |||||||||
5. | In the case of placing order in Online Shop Customer gives following data: | |||||||||
a) | e-mail address; | |||||||||
b) | address data: | |||||||||
a. | postcode and place; | |||||||||
b. | street with house/apartment number. | |||||||||
c) | first name and surname; | |||||||||
d) | phone number. | |||||||||
6. | In the case of Entrepreneurs the above scope of data is additionally extended with: | |||||||||
a) | name of Entrepreneur; | |||||||||
b) | Taxpayer Identification Number; | |||||||||
7. | In the case of using the service of contact form, Customer gives following data: | |||||||||
a) | e-mail address; | |||||||||
b) | first name and surname. | |||||||||
8. | During using Website of Shop additional information, especially IP address of Internet provider, name of domain, kind of browser, time of access, type of operating system. | |||||||||
9. | Navigation data, including information about links and references, in which they will decide to click or about other activities undertaken in Online Shop can be also collected from Customers. Legal basis – legally justified interest (article 6 section 1 letter f GDPR), consisting in facilitating using services provided electronically and in improvement of functionalities of these services. | |||||||||
10. | In order to fix, demand and exact claims some personal data given by Customer within the framework of using functionalities in Online Shop such as: first name and surname, data concerning using services, if claims result from way, in which Customer uses services, other data necessary for proving existing claim, including size of suffered damage can be processed. Legal basis – legally justified interest (article 6 section 1 letter f GDPR), consisting in fixing, demanding and exacting claims and defending against claims in proceedings in courts and other state authorities. | |||||||||
11. | Giving personal data to Geocover is voluntary, in connection with concluded sale contracts or contracts concerning provision of services through Website of Shop, however with this reservation that the lack of giving data indicated in forms in the process of Registration makes Registration and establishing Account of Customer impossible and in the case of placing order without Registration of Account it will make placing and fulfilling order of Customer impossible. | |||||||||
§ 2 Whom are data made available or entrusted to and how long are they stored? | ||||||||||
1. | Personal data of Customer are transferred to providers of services, which Geocover uses at running Online Shop. Providers of services, to whom personal data are transferred, depending on contractual agreements and circumstances are subordinate to orders of Geocover regarding objectives and ways of processing these data (processing subjects) or determine on their own objectives and ways of their processing (administrators). | |||||||||
a) | Processing subjects. Geocover uses providers who process personal data only on instructions of Geocover. These are among others suppliers providing service of hosting, accounting services, providing systems for marketing, systems for analysis of traffic in Online Shop, systems for analysis of effectiveness of marketing campaigns | |||||||||
b) | Administrators. Geocover uses providers who act not only on instructions and fix on their own objectives and ways of using personal data of Customers. They provide services of electronic payments and bank services. | |||||||||
2. | Location. Providers of services have legal seats in Poland and other countries of European Economic Area (EEA). | |||||||||
3. | Personal data of Customers are stored: | |||||||||
a) | in the case, if basis of processing personal data is consent, then personal data of Customer are processed by Geocover so long, until consent will be not withdrawn and after withdrawal of consent for period corresponding to period of lapse of claims that Geocover can submit and that can be submitted against him. If particular provision does not stipulate in other way, period of leap amounts six years and for claims for periodical benefits and claims related to running business activity – three years. | |||||||||
b) | In the case, if basis of processing data is execution of contract, then personal data of Customer are processed by Geocover so long, as it is necessary for execution of contract and after this time for period corresponding to period of leap of claims. If particular provision does not stipulate in other way, period of leap amounts six years and for claims for periodical claims and claims related to running business activity – three years. | |||||||||
4. | In the case of making purchase in Online Shop personal data can be transferred to courier company in order to deliver ordered goods. | |||||||||
5. | Navigation data can be used in order to ensure to Customers better service, analysis of statistical data and adjusting Online Shop to preferences of Customers and also administer Online Shop. | |||||||||
6. | In the case of making request Geocover makes personal data available to entitled state authorities, especially organizational entities of Prosecutor’s Office, Police, President of the Office of Personal Data Protection, President of the Office of Competition and Consumer Protection and President of the Office of Electronical Communication. | |||||||||
§ 3 Mechanism of cookies, IP address | ||||||||||
1. | Online shop uses small files called cookies. They are saved by Geocover on end device of person visiting Online Shop, if web browser allows it. Cookie file contains usually name of domain, from which it comes, its “time of expiry” and individual, at random chosen number identifying this file. Information that are chosen using this type of files help to adjust products offered by Geocover to individual preferences and real needs of persons visiting Online Shop. They give also the possibility to work out general statistics of visits of products presented in Online Shop. | |||||||||
2. | Geocover uses two types of cookies files: | |||||||||
a) | Session cookies: after finishing session of given browser or switching off computer saved information is removed from memory of device. Mechanism of session cookies does not allow to download any personal data or any confidential information from computers of Customers | |||||||||
b) | Permanent cookies: they are stored in memory of end device of Customer and stay there to the moment of their erasing or expiring. Mechanism of permanent cookies does not allow to download any personal data or any confidential information from computer of Customers | |||||||||
3. | Geocover uses own cookies in order to: | |||||||||
a) | authenticate Customer in Online Shop and ensure session of Customer in Online Shop (after logging-in), thanks to it Customer does not have to enter again on each subpage of Online Shop login and password; | |||||||||
b) | analyse and examine and audit the ratings and especially to create anonymous statistics that help to understand, in which way Customers use Website of Shop, what enables to improve its structure and content. | |||||||||
4. | Geocover uses external cookies in order to: | |||||||||
a) | popularise Shop using social networks applying for this purpose tool addthis.com (administrator of external cookies: AddThis, Inc. with legal seat in USA); | |||||||||
b) | present Certificate Thorough Regulations using website rzetelnyregulamin.pl (administrator of external cookies: Rzetelna Grupa LLC with legal seat in Warsaw) | |||||||||
5. | Mechanism of cookies is safe for computers of Customers of Online Shop. Especially it is not possible in this way for viruses or another unwanted software or malicious software to get through to computers of Customers. Nonetheless Customers have the possibility in their browsers to limit or switch off access of cookies files to computers. In the case of using this option the use of Online Shop will be possible, apart from functions that require cookies files from its nature. | |||||||||
6. | Below we present, how settings of popular web browsers can be changed in the scope of application of cookies files: | |||||||||

7. | Geocover can collect Ip addresses of Customers. IP address is number assigned to computer of person visiting Online Shop by provider of internet services. IP number enables to access to internet. In the majority of cases it is assigned to computer dynamically, i.e. it changes at each connection with internet. IP address is used by Geocover at diagnosing technical problems with server, creating statistical analyses (for example defining, from which regions we note the most visits), as information useful at administering and improving Online Shop and also as for purposes of safety and eventual identification of undesirable, automatic programs for browsing contents of Online Shop that load server. | |||||||||
8. | Online Shop contains links and references to other websites. Geocover is not responsible for principles of protection of privacy being in force on them. | |||||||||
§ 4 Rights of persons who data concern | ||||||||||
1. | Right to withdraw consent – legal basis: article 7 section 3 GDPR | |||||||||
a) | Customer is entitled to withdraw each consent that he gave to Geocover | |||||||||
b) | Withdrawal of consent is effective from the moment of withdrawal of consent | |||||||||
c) | Withdrawal does not influence processing carried out by Geocover according to law before its withdrawal | |||||||||
d) | Withdrawal of consent does not cause any negative consequences for Customer, but it can make further using services or functionalities impossible that according to law Geocover can provide only with consent | |||||||||
2. | Right to raise objection against processing data – legal basis: article 21 GDPR | |||||||||
a) | Customer is entitled to raise objection in any moment – due to reasons related to his special situation – against processing his personal data, including profiling, if Geocover processes his data on the basis of legally justified interest, for example marketing of products and services of Geocover, keeping statistics of using particular functionalities of Online Shop and facilitating using Online Shop and examining satisfaction. | |||||||||
b) | Resignation in the form of e-mail message from obtaining marketing messages concerning products or services of will mean the objection of Customer against processing his personal data, including profiling for these purposes. | |||||||||
c) | If objection of Customer will turn out to be justified and Geocover will not have any other legal basis to process personal data, these personal data of Customer, against processing of which Customer raised objection, will be removed. | |||||||||
3. | Right to remove data (“right to be forgotten”) – legal basis: article 17 GDPR | |||||||||
a) | Customer is entitled to demand removal of all or some personal data | |||||||||
b) | Customer is entitled to demand removal of personal data, if: | |||||||||
a. | personal data are no longer necessary for purposes, for which they were collected or for which they were processed | |||||||||
b. | Customer withdrew specific consent in the scope, in which personal data were processed on the basis of his consent | |||||||||
c. | Customer raised objection against using his data for marketing purposes | |||||||||
d. | personal data are processed unlawfully | |||||||||
e. | personal data have to be removed in order to fulfil legal obligation provided in law of European Union or law of member state, which Geocover is subordinate to | |||||||||
f. | personal data werde collected in connection with offering services of informational society | |||||||||
c) | Despite of demand of removing personal data in connection with raising objection or withdrawing consent, Geocover can keep some personal data in the scope, in which processing is necessary for fixing, demanding or defending against claims and also for fulfilling legal obligation requiting processing on the basis of law of European Union or law of member state, which Geocover is subordinate to. It concerns especially personal data including: first name, surname, e-mail address, which are kept for purposes of consideration of complaints or claims related to using services of Geocover or additionally residence address/correspondence address, order number, which are kept for purposes of consideration of complaints and claims related to concluded sale contracts or contracts concerning provision of services. | |||||||||
4. | Right to limit processing data – legal basis: article 18 GDPR | |||||||||
a) | Customer is entitled to demand limitation of processing his personal data. Making a request, up to its consideration, makes using specific functionalities or services impossible, the use of which will be related to processing data included by request. Geocover will not send also any messages, including marketing messages | |||||||||
b) | Customer is entitled to demand limitation of using personal data in following cases: | |||||||||
a. | if he questions correctness of his personal data – then Geocover limits their use for time needed for checking correctness of data, but not longer than for 7 days | |||||||||
b. | if processing data is unlawful und despite of removal of data Customer will demand limitation of using them | |||||||||
c. | if personal data are no longer necessary for purposes, for which they were collected or used, but they are needed for Customer for fixing, demanding or defending against claims | |||||||||
d. | if he raised objection against using his data – then limitation takes place for time needed to weigh up, if – due to special situation – protection of interests, rights and freedoms of Customer prevails over interests that Administrator exercises through processing personal data of Customer. | |||||||||
5. | Right to access to data – legal basis: article 15 GDPR | |||||||||
a) | Customer is entitled to obtain from Administrator confirmation, if he processes personal data and if it takes place, he is entitled to: | |||||||||
a. | obtain access to his personal data | |||||||||
b. | obtain information about purposes of processing, categories of processed personal data, about receivers or categories of receivers of these data, planned period of storing data of Customer or criteria of determining this period (if determining planned period of processing data is not possible), about rights of Customer on the basis of GDPR and right to lodge a complaint to supervisory authority, about source of these data, about automated making decisions, including profiling and about safety measures applied in connection with transfer of these data beyond European Union | |||||||||
c. | obtain copy of his personal data | |||||||||
6. | Right to correct data – legal basis: article 16 GDPR | |||||||||
a) | Customer is entitled to demand from Administrator immediate correction personal data concerning him that are incorrect. Taking into account purposes of processing Customer who data concern is entitled to demand making complete incomplete personal data, including by presentation of additional declaration, sending ask to e-mail address according to § 6 Privacy Policy | |||||||||
7. | Right to transfer data – legal basis: art.20 GDPR | |||||||||
a) | Customer is entitled to obtain his personal data that he provided to Administrator and then transfer them to another, chosen by himself administrator of personal data. Customer is also entitled to demand that personal data are sent by Administrator directly to such administrator, if it is technically possible. In such case Administrator will send personal data of Customer in the form of file in format csv that is generally used format and suitable for digital read-out and allows to send obtained data to another administrator of personal data. | |||||||||
8. | In the situation of exercising entitlement resulting from the above rights by Customer, Geocover fulfils request or refuses to fulfil it immediately, but not later than within one month after obtaining it. However if – due to complicated character of request or number of requests – Geocover will be not able to fulfil request within one month, it will fulfil it within next two months informing Customer prior within one month from obtaining request – about intended lengthening period and its reasons. | |||||||||
9. | Customer can lodge complaints, questions and applications to Administrator concerning processing his personal data and exercising his entitlements. | |||||||||
10. | Customer is entitled to demand from Geocover passing copies of standard contractual clauses, sending question in the way indicated in § 6 Privacy Policy. | |||||||||
11. | Customer is entitled to lodge complaint to President of the Office for Protection of Personal Data in the scope of infringement of their rights to protection of personal data or other right granted on the basis of GDPR. | |||||||||
§ 5 Management of safety – password | ||||||||||
1. | Geocover ensures Customers safe and encoded connection during sending personal data and during logging in to Account of Customer on Website. Geocover applies certificate SSL issued by one of leading worldwide companies in the scope of safety and encoding sent data through Internet network. | |||||||||
2. | In the case, if Customer possessing account in Online Shop, lost in any way access password, Online Shop enables to generate new password. Geocover does not send reminder of password. Password is stored in encoded form in the way that makes its read-out impossible. In order to generate new password it is necessary to give e-mail address in form accessible under link “You forgot password”, given at form of logging in to account in Online Shop. Customer will obtain to e-mail address given during registration or saved in last change of profile of account electronic message containing redirection to dedicated form made available on Website of Shop where Customer will have the possibility to fix new password. | |||||||||
3. | Geocover sends never any correspondence, including electronic correspondence with ask for giving data for logging in and especially access password to account of Customer. | |||||||||
§ 6 Changes of Privacy Policy | ||||||||||
1. | Privacy Policy can be changed and Geocover will inform Customers about it 7 days earlier. | |||||||||
